Need Some Advice for a friend

My friend is 21 years old. A girl that was at his house was 16. Pictures were taken of the two kissing, laying on a bed, and his hands down her shirt. The father of the 16 year old girl got the camera. The 21 year old and 16 year old did NOT have sex. The father of the girl said he went to the police last night and i was just wondering what chargers could be filed. The father has the pictures.
 
It does not appear as statutory rape is option but an angry parent is not good. Parent could seek protective order and get it. The adults reputation in work place could be damaged as well and in public eye. Most people frown aboutn adults fondling minors
 
ok well i have heard two things from two lawyers which in your opinion is the most correct: 1st: The statutes all define minors as 15 and younger for sexual offenses such as statutory rape. Your friend could possibly be charged with a sexual battery if the girl cooperates and testifies it was against her will or she was incapacitated and unable to resist. Below are the North Carolina sex offense statutes for your review.

the 2nd: in North Carolina if they did not have sex it is not a statutory rape case, but because of the age difference would be classified as a 2nd degree sex offense because he was between 4-5 years older. If he was 22 years old then it would be considered 1st degree sexual assault which is a much more serious case.
 
There could also be the taking of pictures of minors engaged in sexual acts. this could be serious. what was done with pictures prior to Dad getting his hand son them? that too could play a role in charges. Was the young lady intoxicated, under influence of drugs? There is much that could be done. the adults best action is to stay away from this child and hope Dad calms down
 
yeah he is staying away and has not been contacted by anyone except through a third party stating that he was going to press charges. The lady was not under the influence of drugs or alcohol. And a few of the pictures were put on myspace. The dad has said he has been the police station and is taking things to the next level for charges to be pressed.
 
Posting pictures of teens in sex acts is a violation of myspace TOS and the law. However until parents seek protective order and/or charges are filed all he can do is wait. However regardless of how this turns out this man needs to stay away from teens!
