I need advice on this situation:
It's for my brother. We live in California. He was involved with this girl for almost 6 years. They never got married because the girl was married in another country and they have a son together. They were able to acquire properties: house and car, but because my brother's credit was bad, she decided to get everything in her name. All his paycheck went directly to her. When they broke up she told him she needed the money to start her life, pay the bills, and didn't give him a cent from their savings.
They broke up a couple of years ago. She is now living with another guy and is 7 months pregnant with this other guy's child. My brother met this other girl and wants to move in with her. But now, his old girlfriend is threatening to take him to court because of this, she was hoping that they would still get back together (her and my brother) because she says she is being emotionally and verbally abused by this other guy.
They have agreed to joint custody from the very start. She makes way more money than he does. Because they have a joint custody they don't give any financial support to each other. They don't split any bills for their son, his medical and dental insurance is covered through my brother employers.
Does she have ground to demand for custody or child support? She also keeps calling and sending malicious text messages to him, can he file for a restraining order based on this? What can he do?
