Good Evening,

I have a question. I am thinking of opening a small bakery here in NYC. My question is the name for my bakery. I have one but I want to know do I trademark the name, so noone else can you use the name?

You can form a company using the name and no one else can form a company with that name. A Trademark doesn't have to be a company it can be a product or a phrase associated with your company slogan. In order to have a national trademark you have to do some complicated research and filing with the FTC. You need an attorney.
 
So I should just start the process of forming my company and that should take care of the name issue?
 
Yes, go to the NY Secretary of State and do a name reservation for your new company. Then complete the articles of incorporation and file them and the company name will be yours. Do a name search and then read the site to see if you can reserve that name online. You may have to call them to find out how to reserve a name.
 
And if you want to make sure there isn't a Federal Trademark, go to uspto.gov and do a search for the trademark. If this is important to you, it may be advisable to speak to an attorney to ensure that your business name is able to be protected. It's a very important part of your business so I think this small step might pay off considerably later.
