will the father of the child need to be contacted for a name change even though there is no record of him being the father?
no paternity established
doesn't pay child support.
never married.
not a part of the childs life

to add...his name is not on the birth certificate as well.

Unmarried males who supply sperm to breed little babies with unmarried females have no parental rights UNLESS they go to court, establish paternity, and seek visitation.

Unmarried female breeders have all parental rights, and need go to court to do what the unmarried male breeders must do.

So, go ahead and change the kids name to whatever you want your baby to be known as.

was told to get a public notice done to try and get a response from the father.
kept trying to mention that his name is no where on the records.
is the public notice necessary?

Some mothers don't know who that father might be, and simply refuse to share it, or say: "unknown".

If you simply "don't know", what's to publish, or who's to be notified?

As you said, no father was reported, so who would you notify?

Seems silly to me, maybe you should visit with a couple AZ attorneys.

The initial consultation is usually provided at no charge.

Its a great way to ask questions, get useful answers for the courts in your county.
