I was arrested on 10/5 for various marijuana charges in the state of Delaware (Sussex County).
I am not the owner of the property, I do live here and the owner was not home at the time dtf came.
I was never and to this day have never been shown a search warrent.
I was placed in handcuffs and remained in cuffs for over 12 hours straight at which time I was taken for arraignment b/4 a judge who read me my charges then gave me my bail amount then taken immediately to prison without being given a chance to call someone and pay my bail. I was never allowed a phone call until 5 days later (after someone posted my bail).
I have never been in trouble before and have no record, I openly confessed to smoking.
I was offically in police custody by 10am and it was 11pm when I arrived at the prison (again in cuffs the entire time) and the only food the dtf saw fit to give me was a small bag of peanuts.
I am a female, worked at a tax paying job my entire adult life (16-38) running retail and/or manufacturing business' and with no criminal record.
Was all this done legally? And wouldn't this treatment be considered cruel and unusual?

You need to hire a lawyer as soon as possible.

If you cannot afford to hire a lawyer and if you are eligible, you will be appointed a public defender.

I have a lawyer. It seems everyone is now focused on the charges and where to go with them and not all the things I mentioned that happened.

If that's where your lawyer is focused, that's probably where the focus belongs.

If you don't agree, then find another lawyer who agrees with you.

I am not disputing focusing on charges. My problem is that I cooperated to the fullest with these people WITHOUT EVER SEEING A WARRANT, they acknowledged I was not the target the home owner was yet they did all these things to me. If people don't start standing up and making those hired to enforce the law, enforce the law by the law WHAT MAKES THEM ANY BETTER THAN THE CRIMINALS?
I was in a car accident at 22yrs. old and told by 5 specialist that there was nothing that could be done for me and I would be paralyzed before I die however they could prescribe me with ample pain killers and muscle relaxers.
I made a conscience decision to use a natural medicine that causes no long term health problems. By doing so I was able to continue to work (and pay taxes) as well as be a productive mother to my children vs. sitting in a chair all day drugged and immobile.......and cotinue to have others medications to counteract the damage said pain killers and muscle relaxers would do over time.
AND FOR THAT THEY DESERVE TO TREAT ME LIKE THAT!!!!!!!

The cops do not have to show you the physical warrant when you are arrested.

The warrant doesn't concern me as much as being handcuffed for over 12 hours and being thrown in prison without the opportunity to even pay my bail.
As well as my family calling for 4 days and never being told where I was.... I had to have an inmate call a bail bondsmen to notify my family as to my whereabouts.

I agree; if you feel you have been mistreated, talk to your lawyer.

If you don't like that lawyer, get another one.

Okay. Fair enough.
Let me throw one more thing at you.
Maryland helicoptors came into Delaware to turn around and found a wooded area with marijuana growing. I have been told by several retired law enforcement people that they were out of their juristiction and that finding this in the woods does not give propabal cause to start watching one person in peticuliar.

In my first question I was basically asking if the treatment I recieved was considered cruel and/unusual, having no record-having the least amount of charges and having the lowest bail. The one person who did not go to prison that night had the most charges- the highest bail and was a previously convicted felon(I was unaware of this) who had ammunition found in his personal belongings but was told if he told them "what they wanted to hear" they would forget they saw the ammo...... they also left him with his paraphanallia and marijuana......
AGAIN I AM NOT DISPUTING I WAS A SMOKER AND BOTH THE OTHER PEOPLE CONTINUALLY STATED I HAD NOTHING TO DO WITH THE OTHER THINGS.
I cannot believe that it was fair to handcuff me for 14 straight hours and not give a single phone call the entire time.......
