My rights w/ developer still in control

I own a home in a subdivison w/ 30 homes. All of the homes have sold except for two. According to the developer there is going to be another phase of new homes starting in a year. The developer still has control of the homeowners association. Currently, each homeowner is paying $100/year in dues. A few of the homeowners have repeatedly asked the developer for a financial statement. So far we haven't reveived one. As homeowners, do we have a legal right to know how our money is being spent by the developer? Can we, as members of the HOA, insist that the developer turn over a budget for the next year?

Also - is the developer responsible for paying the dues on the houses that haven't sold?
