Hello everyone.
In reading at this site, I feel maybe I can get some thoughts ideas and guidence from others who might be going though this or at least has a better understanding of the law.
Ok, my story, I am the single mother of four. Two live with me. Their ages are 8 and 2. The two year old is the one I am having to go to court about. I used to live with my daughters father. he is 35 and i am 38. He has proven himself unfit by not taking his meds for his depresson/bi polar problem. Staying on the computer all hours of the day and night, including when I am at work and he is suppose to be watching our daughter. One day my neighbor called me to tell me he knocked on my door and my two year old answered the door. He was out like a light and had no clue she had even done that. He says it never happened. As he was the stay at home person I thought it was his job to clean and all the fun stuff any stay at home mom was to do. Instead I would have to do it all on my days off because as soon as I got home my two year old would want to be outside. He never took her out during the day when he is there alone. I have found he lies about a lot of things as it suits him. I want to move to Texas since it will be a far better life for us. We will be moving to my son's great grandmother to live. I will not have to work, I can be a stay at home mom again. we will get off welfare and I can continue my college courses to get my BA. Now my ex has stated when he has called me to yell scream and threaten all I can talk about is the past. That the courts are going to look at what he is doing now. Since I moved out with the kids he will NOT let me get their stuff nor mine. He has NOT asked for my daughter NOR how is she doing or anything. He on the other hand has his family support. By support I mean his parents are paying for his lawyer, his sister and her boyfriend are cleaning our townhouse. He is also on SSD for super morbid obesity (he is around 500lbs if not more) and is now taking his meds. I pay for his cell phone of which he went over in minutes. I am the one who provides for her health insurance, food stamps and money for other things. He blames me for all the money we as a family have gone through. My main question is are the courts going to look at his past behavior closely? or more at what he is doing now. I have saved his voice mails to show he has never asked to see her, nor how is she doing. The courts have awarded me sole temporary custody atm. He also says a lawyer(or so he says) told him that since he has not been served he does NOT have to follow what my papers say. According to the papers he can NOT even leave the county we live in with her or he will be arrested. That he can not interfer with my custody of her. Is this true?? He tossed this one at me after my lawyers office was closed. I am paying for my own lawyer, whom most people including a few judges who come into my job know. As I have said his parents are paying for his. All they can do is make excuses for him. My lawyer said my best course of action was to file for sole custody first then to move so he has yet to hear about that part of it. Basicly my kids and I are living outta hotels and friends houses because he wont even let me and the kids stay in our house until this is settled and he move to his parents or a hotel until its settled. Is he right about the court papers?? I believe he was served cause he ran monday to his parents house for a week. But i have no proof as of yet. Oh I also made sure no CPS cases were filed since I would also lose custody of her to foster care because one of us needed to work and he isnt willing.
