18 is the age to leave home. Why doesn't your mother file for custody? That is the only way you can legally go live with her. You are old enough to tell the courts you want to live with mom.

Not necessarily true when you are talking about a 16 year old. Most of the time the courts will take into consideration the wishes of the child. If mom wants custody and the child wants to live with mom, Dad can fight it all he wants but in the end the courts will likely listen to a child of that age. Also if mon can prove any of the threats dad has made, that will not help him either.
