Here is my problem:during a guardianship investigation,what can be expected?
Does the CI follow the parties involved? And at the actual hearing(the unmarried parents of child are not together) must they both be in the court room to hear each others negative findings? Or does the judge excuse each other due to privacy concerns? And finally in my particular situation the baby,s dad has 2 other children from a previous marriage to which he is over $12,000 behind in child support,rarely visits them etc. Does his history with his other children affect the judge's ruling. The child has been living with my wife and I over 1 year. Baby's mother stays in our home(hardly ever) in the last 4 months.She is afraid the baby's dad might get custody if my attempt at guardianship is unsuccessful(if negative findings are revealed at the hearing
and is heard by baby's dad). She can not this time provide a safe place for her and her son. She more than likely has some medical situation(s) going on. Baby's dad track record speaks for itself. Thanks!
