Moving out of State

I have sole physical custody of my two minor sons. There father hasn't seen them in nearly two years, and has made no attempt to contact them. He doesn't pay child support, and has only paid 1,000 dollars in the last six years (He owes arrearages of $34,000). He is unemployed and has a history of drug abuse. My new husband has been supporting them for five and a half years, and has been offered a wonderful job in Oregon. We would have greater medical benefits, retirement, and smaller schools with a lot of extracurricular activities. My question is what do I need to file to be able to gain permission to remove my minor children from the state. There is nothing in our paperwork that says they cannot be removed, but I don't want to get arrested for kidnapping! (My ex does have joint legal custody)
 
If your ex has joint legal then you need to get the courts permission to move. If you can prve it is in the kids best interest, and that dad has not been around, then you will probably be allowed too.

I don't have any idea why he hasn't seen the kids. He is a known drug user and has actually tested positive for methamphetamine during our custody battle. He has also been arrested for terrorist threats towards my husband and myself. This should give you some ideas about his character....
