My jurisdiction is: Illinois
I live in Manteno, Illinois and I would like to move to Arizona. I would like to know how good of a chance I have of leaving the state...Heres why: I have a 5 year old daughter and have joint custody with my ex husband. I am the custodial parent and have been since we split up 2 years ago. In our divorce decree it states that he is to pay child support and have visitations every other weekend and 2 days a week. He does not pay child support and for the most part does not take her every other weekend. He has never taken her during the weekday like he is suppose to, he has no drivers liscence and lives with his girlfriends mother. He is at least capable of helping a little financially, but chooses not to. I have had very little help and support from him with raising our daughter. I have great opportunities in Arizona if we are granted to move. I have family out there that is very much able to help both my daughter and myself. I have a job waiting, a vehicle, a home for my daughter and myself, and also a wonderful school less than 5 minutes from the home we would be living in. I can prove all of this and come up with anything that is needed of me to show it is better for not just me, but more importantly for raising my daughter. She has also established friends out there through visitation, which she does not have here. Also we have family there, that is more than willing to help and give us the support we need, which we are by no means getting here, let alone help from her father. I will be more than willing to pay for her to come visit over summer, holidays, or any other type of vacations/visitations with her father or anytime he wishes as long as it would not interfer with her schooling. I am not doing this to take her away from her father, but like stated before he has not been much of a help or lived up to his responsibilites in the divorce decree. I would like to take my daughter somewhere where we can have a good life. I would like to know what I would need to do or how good my chances would be of having this approved by court. Any help or advice would be greatly appreciated.
