If the DA has no real evidence, such as in a DV violence case, witness will not testify, no 911 call, no priors, no signed statements by parties, only what the police report indicated. Original plea was Not Guilty. Can the case get dismissed at this point? How much evidence do they need to proceed to trial. Can the DA plea bargain with defendant at this point? If so does the Defendant have to plead guilty? Can they plead Nolo Contendere? Do a 36 week Diversion program and have the case dismissed then? How do we get this case dismissed and not plead guilty and not go to trial?
