Hi there everyone. I'm at a loss for what to do here... Hopefully someone can shed some light on this situation.
My son is 5 years old. My wife and I separated when he was 2 1/2 and she moved with her parents (a little less than an hour south of me). Initially, we worked out that I see him every other weekend until the divorce decree was set. She kept making excuses (mostly that he was sick) and denied me about a month and a half worth of visitation. We got on bad terms, things were said back and forth. Then, she suddenly moved to Houston and I lost contact with her and didn't see my son for maybe 3 months after... it seemed like a year. She called me out of the blue letting me know she was going to be in town if I wanted to see him. I saw him that weekend and we made arrangements for me to see him one weekend every month.
Shortly thereafter, Hurricane Ike came leaving her with no power, so I gladly watched him for 2 weeks until she could "get back on her feet". She supposedly did, took my son back, and shortly thereafter lost her job due to missing work (unrelated to hurricane). She moved back up with her parents. After much deliberation, I finally got her to sign divorce paperwork February of this year (was in the works since she contacted me while living in Houston). Joint custody, me being the NCP. Typical decree - cannot move out of current or contiguous counties. I see him every other weekend.
Each of the last times I have seen him, she takes a trip to Houston to visit her boyfriend (who she has claimed is the "thug that she wants"), and each time she would call on Sunday to make arrangements for me to meet her parents because she wasn't coming back in time. Her parents are fed up, and this past weekend, her parents said that they told her it was not going to happen again.
So she calls me yesterday letting me know that she was moving that very day to Houston with my son to live with her boyfriend.
I know this is long... sorry about it... but so much details...
My son has been having developmental problems. He doesn't talk like he should by now. He isn't potty trained. She had him evaluated and doctors say that he is at the level of a 2 1/2 year old (his exact age when she left) and is not autistic, which lets me know she hasn't done much since she has been the primary. When I would ask how he is doing, she would say "oh he's a bad kid as usual". I'd hear him screaming in the background to no action by her. He is seriously an ANGEL child at my house. I'm strict with timeouts when he knows he's wrong, and she thinks I'm too strict but spanks him (to each his own, but it's obviously not working for him).
She hasn't even mentioned talking to a judge to modify the order. She isn't even thinking about it. I was already planning on calling CPS, as she has had no job since being here and in the TINY 2 bedroom house she was living in with her parents and her 13 yr old brother, no one else has a job either. that all changed when she sprung this on me.
I don't know what to do, and I don't have the money for a lawyer right now to help me figure it out.
Any light would be greatly appreciated. Sorry for the book you just read... lol.
