Mother leaves State of NY under false pretense

Me and my wife seperated after the foreclosure of our home here in NY. I was going to live with a friend and she was going to live with her sister till she could find a place for her and our two daughters (11 & 15 yrs). Two days before she was supposed to move in with her sister, she tells me plans have changed (Very thin reasoning, was obviously not true). Anyway, she decided she was going to go to Florida and see our son off to college (as was I) and then she was going to visit her mother for two weeks before returning to NY to find a place. Well, two weeks turned into 3 months. Once I found out she registered the girls in the Florida school system, I filed a custody/visitation petition here in NY.

My question is this.......I do not want my daughters living in Florida. I am contending that my wife could return, get a job (or two) and get a small place for the three of them. After all, the girls were born and raised here in NY and no nothing else. Also, the girls thought they were going for a two week visit to their grandmothers, so she pulled the wool over their eyes too! What are the chances the children will have to return to NY????
 
The chances are ptetty decent she will have to return the kids but nobody knows what the judge will do. When is your hearing? Good for you for at least filing something in NY before her 6 months were up in FL.
