I live in MN with my now 2year old son and have for 18+ months. The father lives in WY where the initial support order stands. He is supposedly taking me back to court for a modification because now I make more money than I did when the original order was placed. We were never married, he signed the ROP, is on the birth certificate. There is no long distance parenting plan in place. He has never asked to see our son since the separation. Only recently has he asked and throughout the separation (don't know what else to call it) he threatens to take custody if I don't do X.
In the original order the only reference to expense other than just plain old support was made to medical insurance, which I agreed to provide due to the fact that his employer provided med ins would only provide out of network services (which are expensive). Since then, I have a full time job, my son is in daycare and the medical insurance that I provide (which was state provided initially due to only working part time) is nearly double what was initially thought.
He has not paid for July (he usually pays monthly, but seems to think that withholding cs is ok when I don't do something he wants me to- which is quite often), and has sent me a number of emails threatening me with visitation orders that he says I need to be prepared for. I have not nor will I ever say or try to keep him and our son apart. I moved back here to live with my family (with his full knowledge and forewarning- he could have stopped me) and be able to support D. From Feb 1 until the 8th of July, there were no phone calls (not that there ever have been) only two packages and cs came as unpredictably as usual.
We have a vehicle loan together, which I have been unable to refinance. The credit union and I have been working together to try and get the payments lowered so that I don't have to default on the loan, that it doesn't hurt anyone's credit and they don't have to come get the vehicle. He was all for the refinance only in the last week or so saying that he isn't going to sign afterall until I get his cs lowered since I am working now.
Here are the questions: are modification of support retroactive? Can he get his cs lowered if he is in arrears? How would I get the standing wage withholding activated since he is behind by the 1 month requirement?
About visitation:
Since he has not seen our child in 18+ months (our child is only 2) how long would supervised visitations be acceptable until he would be able to leave the state with our child?
Since I am the one who created the distance (honestly only to better our circumstances!) would I have to provide the transportation for the supervised visitations?
