I have been divorced in August two years and have a seven year old daughter. Well, to begin my ex husband doesn't want to follow the rules and he wants to make his own rules to suit his needs. I know that last summer I couldn't afford to pay day care and was suppose to get our daughter evey other week. He agreed verbally that I could get her every weekend during the week. I know that this isn't a legal binding agreement. I also allowed him to get her every other weekend just to be nice. In our divorce decree I was to have her every weekend. So, I know that I was wrong in doing both of those items, but I thought I was doing the right thing and allowing my daughter to do more with him during the weekends. But, one Friday afternoon he failed to bring her to meet me on my weekend which I filed a police report. Also, I typed up a certified letter detailing all of my rights as described in the divorce decree which he told me doesn't mean anything just a piece of paper. I'm not allowed to go to their house to get her that is why they meet me. This afternoon his soon to be wife physically assualted me and I filed another police report against her as well, as a warrant for her arrest. My question is since I violated the divorce decree in the summer, and the every other weekends items do I have enough to go back to court to ask for full custody along with child support. Or what else do I need to do before I can take him back to court?
