So tonight I was designated driver a few of my friends home from a party. Apparently, I turned right on a red light when I shouldn't have and got pulled over. The officer asked how much we had all been drinking. I said none (truth) and the other three said they had a few beers (also truth). We told him we were on our way home, which we were, and then he asked for the everyone's IDs. One of the passengers was 20 (the other two were 21), and he took my ID and my 20 year old friend's ID back with him (for the record, I'm 20 as well). The officer came back, didn't ask me to blow, but asked my friend to get out and blow, and he obviously failed and therefore got hit up with an MIP and I got the traffic ticket.
I know in Michigan they have a probation system where someone can get away from having the MIP on their record (I'm actually on it right now...), but I've also heard that officers must first ask the driver to take a PBT test before administering any others to the passengers. Is that true? If so, my friend should have a chance to get his citation completely revoked, correct?
The whole situation is a downer, considering he was making the correct choice and not driving...
