Minor name change

I have a 3 1/2 year old daughter who's father has been in prison for most of her life. I have sole physical and legal custody and I have waited the mandatory 2 years of no contact or communication from the father before filing a petition to change her middle and last name. I am about to file and wanted to know if I would have any problems changing her name since I do have sole legal custody. I did ask for the father's consent in the past but recieved no reply.

Sole custody does not mean a name change. You still might need his permission. All you can do is submit the paperwork and see what they say. Unless you are terminating his rights too, I doubt he will agree to the name change, then be subject to child support when he gets out.
