Medical marijuana and kids

I live in Colorado and have custody of my son who is five. His father has visitation and gets to see him every weekend. On many occasions I have went to pick up my son at his fathers and smelt the smell of marijuana. I finally got tired of it and the last time I called the police on him. They went over to his house and talked to him. When they called me back they too smelt the marijuana but they couldnt do anything about it because he had a medical marijuana license. I asked the officer if it was against the law to do it while there are kids in the house and he said as long as his ability to care for the kids isnt impaired. I know the officer felt bad for jme but like he said legally there was nothing he could do. I am a single mom who goes to school fulltime and I dont have the money to hire another lawyer. I dont think that his fathers is the best enviroment for my son right now. I can afford to go to mediation but I please need to know if medical marijuana is reconized by family courts. I must do something. I dont want my son to grow up and think this kind of behavior is ok. :mad:
 
Although I must say that it appears that soon half the country will have some type of "medical marijuana license" as justification for using this, would you feel the same if your ex was, say, a diabetic who required daily injections of insulin (thus having needles and syringes around the house)? Blood pressure medications which, if used improperly, would likely cause impairment?

The officer was actually right - unless you can PROVE that Dad's smoking marijuana is detrimental to your child's health, the court just isn't going to care a great deal (if at all).

Honestly, most family courts view marijuana much the same as alcohol.

Ugh..I actually know a CP Dad who suffers from angina and thus, he keeps nitroglycerin handy. This can cause a dramatic decrease (if temporary) in BP...and on this one occasion, he took his nitro because he was having chest pains and had to sit down very sharply. He accidentally sat on his son's foot, who was also on the couch at the time.

No harm done. At all.

But Mom tried to get custody changed because of this one, single incident.

Thankfully she was unsuccessful.
