It seems from experience that a particular mechanic in Tillamook Oregon is being awarded a string of victories in the county court of Tillamook - based on really nasty and probably marginally legal tactics - it appears that the Plaintiff/Mechanic and the Judge in these cases are acquaintances. There is now a group of disgruntled customers that have been sued by this mechanic, who are now joining together to see whether we can reclaim what we have lost in these dubious charades of pseudo-legality.
Most of the cases revolve around the plaintiff/mechanic, doing work that he wasn't asked to do, then payment is demanded, if the customer/defendent does not immediately comply, a lawsuit ensues and an outrageous storage fee ($25/daily) is charged for the property (usually trailers).
This mechanic pulls all the stops, from mechanics liens to bank accounts and wage garnishments. If it were an isolated case, maybe the law was being served, but considering the histories, the number of cases, and the usually undisputed awards that the plaintiff consistently reaps from his victims, it is time his practices were examined more closely.
We/the disgruntled customers of Tillamook RV and Repair, have formed a group with a website: www.tillamookrv.com to gather together other customers who feel betrayed by the justice system of the county of Tillamook - it is still in progress, but two cases are already posted.
Questions: I was wanting to ask specifically, whether we can form a class action suit, and on what grounds, considering all of these small claims awards. I wondered if a lack of privity in the 'contracts' could be cited, or that this 'storage fee' was an illegal form of usury....which is usually limited to 10% but in some of these cases would be equal to %1500 interest.
Are court case claim numbers, or a history of lawsuits filed in the county court by the same plaintiff publicly available documents?
How can we find out and contact other defendents to collect and hear their stories??
