Anyone who can provide advice or a solution would be appreciated. Here's a brief description of my problem.
I currently live in Massachusetts. In 2004 my wife and I were seperated. In 2004 the children were taken from her as part of a C&P (Care and Protection) because of her drug use etc..
The children ( at the time: 8yr old stepson, 3yr old son, 1 year old son) were given to me by the court. I was granted sole pyhsical custody but with joint custody.
In 2007 I was granted full guardianship of the NOW 11yr old, and still had the other two boys. In Aug 2007 I gave physical custody to the mother after beliefs and reports of her substance abuse being eliminated.
Now the problem...(note: we are in the process of divorce also.)
1. I recently had a Paternity test regarding the NOW 4yr old child..Results: NOT MINE.
QUESTION: Can anything be done to my spouse legally because of her "blindsiding" me. According to her she has know from day 1 that the child was not mine and does know who the biological father is.
QUESTION: Am I able to obtain any monetary amount that its cost me in caring of the said child because of my spouse's deception.
2. Now that I only have physical custody and joint custody of the 7 yr old child and guardianship of the 11 yr old child, if she requested a paternity test of the 7 yr old child..and the results turned up that the child is NOT mine what are my options? The child does not want to be with his mother, does not know anyone besides me as a father, and has told school counselors and teachers of his desire to be with me. Because of my spouses deception before I now am worried that the 7 year old may not be my biological son.
QUESTION: Because of her past..and my desire and the childs desire to remain with me along with the older brother..my stepson of whom I have guardianship over. Am I able to request sole custody of the 7 yr old, although the child may not be mine? Options??
NOTE: Spouse/Mother has had an ongoing substance abuse problem, ongoing history of mental illness and had numerous medical problems. All ahistories have ave been documented and verified by DSS.
