This past weekend I was driving home from work and i had a case of bacardi on the floor of the back of my car. I will be 19 in 3 weeks. The alcohol was not mine it was purchased by a friend. A day earlier, we were hanging out and she had purchased the alcohol, she is 21. Her younger sibling had to be taken somewhere. So when we got back to her house she asked if I could leave the alcohol in my car so her younger sibling didn't see it. I agreed and told her she could just get it back from me in two days when we had plans to hang out again. I forgot about it and the next night I was driving home from work and didn't completely stop at a blinking red light and was pulled over. The officer saw the alcohol in the back on the floor and took it. I told him a friend gave it to me. I was given a breathalyzer and blew a 0.00 as I had not been drinking and hadn't drank any of it. There were four bottles of unopened bacardi and 2 bottles that were gone but closed. He gave me my license back and gave me my ticket and told me my court date. On the ticket it says 4 bottles of bacardi in backseat and didn't say anything about not stopping completely at the blinking red light.

I was wondering how I should plea to this, would a plea bargain be the route to go? What should I expect for punishment? I am a delivery driver for a pizza place so losing my license would cost me my job. I also go to school 45 min. from my house. Losing my license would stop my life completely. I have two tickets on my record, a speeding ticket for 65 in a 55 and a minor traffic accident. I have to go to court in a week and a half. What should I expect and what should I do?

Calm down……….you would not loose your license. You seem to have a good chance of fighting the charge. A good lawyer can try to pull this off. Don't take a plea deal. Talk to your lawyer to evaluate all options. Your lawyer might be able to handle this and get the charge dismissed. Do a free consultation with a lawyer. Most lawyers have a free initial consultation. Meet with one in your county who is familiar with the local court practices and local disposition methods. At worst in your situation it would be a fine with maybe a class or something like that. You can google the statute of your state online…….Talk to your lawyer so you can get this off your record.

Will I have to name the person who gave the alcohol to me? Will they be contacted or have to get involved or will they be in trouble?

this will be my second mip

i live in Michigan, and i guess they got a little stricter on there MIP laws.this will be my second mip in ln less than a year. i am still on probation from my last one. but heres the story... last night i was at this party. i had a couple of beers hung out for a while then when i went outside. like 5 cops come running up on me. now the kid who's house the party was at was smart. he knew the cops couldnt just come in the house with no warrant. well what i was really wondering though is if the cops never gave me a breathalyzer so see my bac level. then how could they even prove i was drunk at the time? on my other mip ticket it said my bac when the ticketed me. im just looking for any kind of help you guys could throw at me. like what i might be facing, if i will be able to get my licence at 18 still. and if i could try to fight this case.
