lost and dont know where to turn

i need to know if it is elegal for my daughters father who has asked to relocate to take the child and relocate her before the court has a hearing and what i can do to bring her back home i have filed to stop the relocation but we dont have a hearing till january is that kidnapping and can i charege him i have visitation and she is supposed to be going to counceling but both have stopped

File for a preliminary injunction before the custody judge. The injunction will prevent him from moving the child.

he already moved the child with out promission from the court we have a hearing in jan for them to say weather or not she should be moved but he moved in august and took her already i need to know if he can do that and if it is legal if it isnt i need to know what i can do to get her back to where we live
