Ok heres the scoop:
This is concerning my 6 year old nephew, it starts back to when my sister became pregnent with my nephew 6 years ago by her boyfriend (who I will discuss later). After my nephew was born my sister moved to the town where most of our family lives. Everything was going fine then she decided to move to a town about 3 hours away. She started to call less and visitations were becoming very rare. There is a lady (who I will call Lady 1) whos name I will not mention who raised the father of my nephew but is in no way legally or biologicly related to my nephew, his father or either of our familys.
My nephews father ( who I will call Dad 1) whos name will also not be mentioned was taken from his biological mother when he was a baby, there was no adoption paperwork as to my knowledge, lady 1 told the bio/mom of my nephews dad that she will take and raise dad 1 and that the bio/mom can continue to collect Section 8 and Welfair regardless of the fact that dad 1 is not going to be living with her, which im pretty sure is fraud in some way. From what i have gatherd from people who have known lady 1 for more then 20 years say she has always been able to (metophoriclly speaking) twist peoples minds to get them to see her side and agree with her. Thats how she accuired dad 1 and I feel she is doing the same thing to my sister now in order to once again accuire another child aka my nephew.
My sister was doing ok for a while, she was going to school and looking for work, and she even started to come around and see that lady 1 is a lier and, well to put it simple a baby stealer. Dad 1 came back into the picture and they were all going to counsling to help fix any issues, then up and out of no where she gives my nephew to lady 1 and says she cant handle him anymore. If it comes down to court i want to know what my options are for gaining custody of my nephew and, I want to tell the courts (if it comes to that) that my sister is not mentally right based on the fact the lady 1 has been twisting her mind, i am in the process of gathering proof of lady 1's actions and if court happens i want to make sure my nephew is not handed over to her AT ALL!! if the dad sides with lady 1 (which i dont think he will) but doesnt have the capability of supporting his son, i wanna know what my chances are and what i would need to do in order to get custody of my nephew. I am about to turn 23, I am a US soldier in the United States Army, i have been in for over 2 years and am almost finished with my tour in IRAQ, if i am able to get custody of my nephew I will be able to support him with the best medical care and schooling the ARMY has to offer, and he will always have a roof over his head, food in his stomach, and toys to play with and he will be loved deeply by me and the rest of my family who has not seen him in quite sometime (because of lady 1). There is much more to the story but if I were to try and type it all out im afraid it will turn into a book, any advice and or options of what i can do if this does go to court would be extremely helpful.
