Logging into ex's account that I set up. .?

Hi there! I have browsed the forum for an answer to my question, but no other situation seems to be exact..?

My ex and I lived together for 5 years and, due to him being disabled, I ran the household, including his bank account. I set it up online for him to keep track of his purchases and I set up the password.

We are now separated and fighting for custody of our 2 kids. He is claiming "financial hardship", but I know from looking at his account that he spends all his SSI on porn sites, yet gives his kids nothing!

My question is - since I set up the account, is it legal for me to use that info against him in court? He has never bothered to change the original password, so I didn't "hack" anything. .?
 
SSI isn't a boatload of money. By the way, since you possess access to his account, a smart lawyer might convince a jury that YOU'RE the one spending his lousy $800 on porn. The guys an invalid, and you're healthy trying to get his SSI.

If hes claiming hardship he will need t prove that. He will have to show where his money is going. If he is spending it on porn he will either need to report that or ignore it and explain where the surplus income goes. As stated SSI is a measly amount you will be hard press to show he has any surplus income while on SSI.
 
Though one could possibly get a judge to grant a support order against someone on SSI, the money cannot be garnished to pay support. The balance would likely be a minimum order for the state involved and would continue to accumulate until he dies, becomes non-disabled and works, wins the lottery or inherits money. You on the other hand could likely go to jail for accessing his bank account.

Just because your title says "judge", doesn't mean you should when you don't have all the facts.

First, I didn't say we were married. Second, he is FAR from being an invalid, he simply has seizures, but he smokes 2 packs a day and watches porn 24/7 with no problems. He's as mobile as the rest of us. Third, NOWHERE did I say I wanted his money! You are SO quick to defend a jerk you know nothing about. He was abusive to me and the children, then had his mommy kick us out of the house with nowhere to go, then he took my car, leaving me with no way to get the kids around, or get a job.

Notice how you said they are my kids "too" - why should I have to support them with no help from him? I've had to go on government assistance just to be able to feed them and get them diapers, clothes, etc, but he should be allowed to spend over $600 a month on porn and escorts, then claim he's too broke to support his kids?

Now that you've been educated, maybe you can be useful and actually ANSWER my question...?

Since I set up the account, can I use his purchases against his claims of "financial hardship" in court?

Shrinkmaster, and disagreeable - I already understand he is most likely non-collectable due to his being on SSI, that wasn't the question. I just want to know if I can use the bank account info legally since I set it up. I didn't hack or forge anything, but I didn't know if there was an issue since we are no longer living together.

You are missing two main points. First, he is currently judgment proof because SSI cannot be attached for CS. Second, you are now complaining about the logical evolution of an act you could have prevented by simply keeping your panties on. Your failure to ascertain a person on SSI cannot be garnished for CS should have been a epiphany 5 years ago, when you thought it was great to always have someone around to schtuup you and spend time with you when you were in the mood.
