liability of accident- charter school

My partner was driving down a residential street after 5PM during rush hour. Suddenly a ball flew out from the right side of the street causing multiple cars to swerve and my partners vehicle and another vehicle to collide. My question is, does the school have liability to this accident since it was caused by their students? If so, how do we go about this? Our vehicle was totaled and my partner is suffering from medical injuries. Any help would be appreciated.- Ramon Navarro
 
Your case is based upon the specific facts and circumstances of your case. The question that probably needs to be answered is whether the school was negligent. What about the person responsible for the ball entering the roadway? How do you know that the school should bear any liability for your damages? Perhaps a child threw the ball while with a parent or custodian. In such an instance the school would likely have no responsibility to prevent this from occurring and thus not be liable for causing your accident.
