Hi,
This is a second attempt at this question as my first never posted to the forum.

Can a merchant retain a credit card payment for merchandise which was NEVER delivered ? Purchased a remanufactured engine over the phone in Portland,OR for a vehicle which was sitting in a repair shop. Ultimately canceled the order due to their inabilty to meet numerous resheduled delivery dates for a period of nearly 4 weeks ?
(Was originally quoted a 3 day delivery when order was placed.)

Original charges disputed w/ credit card company are now being reversed claiming merchant has provided evidence of a signed sales order w/ a "No Refund Policy". I have never signed a sales order or was informed of such a policy
and was forced to cancel the order due to their inability to deliver. Please note merchant also has web advertisements of a "100% Money Back Satisfaction Guarantee" for what that's worth.

Any insight is greatly appreciated and thanks in advance.
