legality of 2 marriages?

I know someone who is married to a guy in another country but they been separated for many years. The reason they never got a divorce is she have lots to gain if he end up dying. I think the reason he never got a divorce is he probably still love her.

So what happens if she got married again with another guy in USA without getting a divorce? Or is it still better for her to get a divorce first?

Then she will be a bigamist. "Every person having a spouse living, who marries . . . any other person, . . . is guilty of bigamy." Cal. Penal Code section 281(a).

"Bigamy is punishable by a fine not exceeding ten thousand dollars ($10,000) or by imprisonment in a county jail not exceeding one year or in the state prison." PC 283.

Also, since she would be unable to acquire a marriage license without lying about the prior marriage, she would almost certainly also commit the crime of perjury.

Or is it still better for her to get a divorce first?

The only legal way for her to marry someone else is to divorce her current husband.
