My boyfriend has a 4 year old son that he has full custody of, and 18 and 14 year old children from a previous relationship. The mother of the 18 and 14 year olds told their case worker that the 4 year old is not biologically his. His name is on the birth certificate, and the mother gave him custody. With his name on the birth certificate, doesn't that give him legal rights to child support even if he's not the bio father (but we strongly feel that he is)?

Yes he is the legal dad, who cares what mom says. Did family services remove the child from moms home? Most state would not allow paternity do be disputed 4 years down the road if he is the legal father.

The mom that's disputing it isn't even the 4 year old's mother. She is saying it in hopes of getting more child support for the 18 and 14 year old children. The child support worker says that she can't go any further in processing the child support he should be receiving for the 4 year old until paternity is established. But he is on the birth certificate, and has had sole custody of the child for the last year, and the mother has skipped state and has not contacted the child at all.

It is none of that womans business. She is has nothing to do with Dad and the mother of that 4 year old so her claims will not go anywhere.

I was able to find the court documents that clearly state him as the father, and they are signed by the judge. That should be sufficent enough for the courts shouldn't it?
