We are not sure if there are any legal implications to this matter, and would appreciate any advice, etc.
Yesterday my husband received an anonymous email with pictures of his ex-wife. The ex-wife has primary custody of thier two children.The pictures were from a Halloween party the evening prior. During this time, the two minor children of my husband and his ex-wife were in the upstairs of the home (which was not the ex-wife's home, but the home of her friend). My husband knows that the children were there because they told him 2 hours before the party that "Mommy is having a party, and we're going to stay upstairs because it's a big-person party."
In the pictures, ex-wife is doing a keg stand, taking shots of liqour (we can only assume as she has a Jagermeister bottle in her hand), drinking from beer bottles, and there is a notable picture of her with her leg up on a table and she is wearing no underwear.
In addition, in about half of the epictures, there are high-school children in the background. We know this because my husband and I used to teach in the school system and recognized some of them. They are between 14-17 years of age. Ex-wife is 30.
Due to husband and I working in the district for years, we feel a high-schooler probably emailed the pictures.
In some of the pictures, the high-schoolers have plastic cups, but there is no direct evidence that they are drinking (ie-filling up cups from the keg, holding liquor bottles, etc). There is one picture of ex-wife taking a shot with arm around high-schooler.
Again, I don't know if there are any legal implications to this. Unless husband can get ex-wife recorded stating that children were upstairs, there is no way to prove children were there (with the exception of a witness deposition, I suppose). Also, I don't know if this is enough to demonstrate that underage children were drinking.
I'm worried on two levels: as a stepparent and as a teacher.
We don't know if this is enough to warrant retaining our lawyer again (last used him 4 years ago).
