Leaving my home state with children

I fled from New York with my 3 children to get away from their father because of physically and verbally abusive towards me. I took them to PA and their father is threatening to petition the court to force me to return to NY. My lawyer is telling me just to try to keep him unruffled for 6 months so I can claim PA as my residence. Can he force me to return?

If he actually goes to court, then yes, you may be ordered to return the children to NY.

Yep if he files in NY then they will have jurisdiction. If you have no police reports then you'll have a tough time proving the violence. without any proof of your allegations he is just another father that is entitled to see his kids.

Keep in mind that if you are allowed to stay in PA, you may wind up providing all transp. to visits, or at least half.
