A NOTICE TO APPEAR was mailed 20 days after an alleged violation (red light violation caught on camera) in California, received 23 days later. Section 40518 (a) indicates NOTICE must be delivered within 15 days to constitute a complaint. Is there a mechanism, prior to a trial, to have the NOTICE thrown out due to its late delivery?
