Can the payment of the last month rent be used in defense to an eviction for non payment of the rent? My tenant (state of FL) has paid first, last and security when moving in (with a receipt stating what the payment was for first, last and security).
Now tenant has not payed rent for may (second month into the lease) and says that she is not late since she paid last month rent. FYI, I am in state of FL and using generic lease agreement with 6 months duration that does not specify anything about last month rent.
