I've had my medical marijuana card for over 3 years..moved into my new place about 6 months ago.. the neighbors are complaining about the marijuana smoke so the landlord is trying to evict me...she said no smoking inside the unit..is it legal for me to smoke outside the unit without any trouble?

Marijuana smokers must observe the same laws that apply to tobacco smokers.

You can be evicted for not restraining yourself from disturbing the pure air that CA anti-smoking laws were deigned to provide.

You can also be cited for violating anti-smoking prohibitions and ordinances.

The link discusses important tips for WEED PUFFERS.

Yes, you can be evicted. Either follow the rules or find a new home and discuss this concern with the property owner before you sign a lease.

Keep in mind that if you are in federally subsidized housing (section 8), you can also be booted simply for possessing marijuana whether legal in CA or not. The feds do not recognize marijuana as medicinal or legal, so possession and use can get you booted.

If you are paying your own full ride for rent and all, then you are subject to the terms and conditions of your lease and this may include a prohibition against disturbing others, smoking, illicit substances, etc.
