land lord Eviction Grounds

    I need some help my land lord is kicking me out at the end of the month and it wasnt even 30 days and i dont have no where to go so can he do that or does he have to give me more time

    Only a court can have you physically removed from the apartment, LEGALLY.
    The landlord can ask you to leave, but can't MAKE you leave!
    A landlord is required to serve you with a notice to vacate, essentially informing you to leave by a certain date, otherwise the landlord is required to take you to court if you voluntarily decide NOT to leave.

    More than likely, you aren't legally required to leave at the moment.

    This doesn't mean you can stay because you need more time to find new digs.

    It means you are entitled to "due process".

    It also means, in WI, that you can cuyre the default that caused you to breach the lease and pay your back rent.

    NOTE: A notice that your lease will not be renewed or a 28-day notice to end a month-to-month tenancy is a "non-renewal notice," NOT an eviction notice. However, if you stay past that date, the landlord can take you to court for eviction for "holding over" (staying past the lease expiration date).

    According to Wis. Stats. 704.17 & 704.21, all eviction notices must:

    Be in writing,
    State the number of days the person has to take action,
    State whether the tenant has the right to cure (fix) the problem,
    State whether the tenant can fix the problem and can stay, or if they just have to leave, and
    State whether the rent is due (should include the amount) and/or the lease clause that the landlord believes has been broken.
