So I am charged with felony of a class three burglary and misdemeanor theft. The burglary was residential. I messed up. First offender. And already waived my right to a preliminary hearing to keep a plea bargain on the table. Diversion program is out of the option because it is a residential occurance. I have yet to talk to the DA and am defending myself. The plea bargain on the table is to plea to a class 4 felony and pick up a 2-6 year sentence at DOC. How can I change this? Maybe get a deferred sentence for probation??

It is never too late to request for the court to appoint an attorney. That is your best option.

A first offender has a great shot at probation.

That said, you're not guilty as charged, you're innocent until the state proves your guilt (or you plead out).

There's no way you go to prison, if things are as you describe.

Do as suggested, ask for a public defender to assist you.
