My ex husband and I have joint physical and legal custody of my daughter. It was up to us on making decisions for her for schooling and so forth. We decided that I would put her through school and he would get her on the weekends. She is 4 years old and in pre-k. I received a letter from his current lady in his life saying that they weren't going to bring her back to me. This weekend. That I was going to see her on the weekends. Is it legal for him to take her like that. And pull her out of school. Well he doesn't know what school she goes to. Everything is confidential on my end where I live where she goes to school and so forth but he does see her on the weekends. If he decides not to bring her to the meeting place where I am suppose to get her for her to go to school for this week is that considered kidnapping even though we have joint physical and legal custody?
If you have physical custody then call the police and ask for help in enforcing the decree. Otheriwse its time to go to court and file for temp. custody. An attorney should be able ot help or go down to the courts and see if they have a family law fascilitator.
