I am a New Hampshire resident who has joint legal custody of 2 children. One parent wants to send our 13 year old daughter to an out of state private boarding school, the other parent does not.

Can one parent make this decision alone without the other parent's consent?

Do both parents have to consent to this?
 
You can not make a decision that would deprive the other parent of court ordered visitation. So, whoever has decision making authority (the final vote-the custodial parent) CAN send the child to boarding school if you want to pay to bring the child back for the regularly scheduled visits for the other parent.

Just as a side note from one parent to another: WHY in the hell would you want to send your own child off to boarding school at 13?
