is lease valid?

we relocated to DE (new castle county) in June 2009. we are renting a single family home. we've had some issues from move in. we've managed to fix two, but a third still exists. The landlord had lived here previously and had 4 dogs. There is a smell of old dog pee in the dining room and living room carpets that we can't get out. we've tried carpet deodorizers, scrubbing, etc. with no results. we've communicated to the landlord about this several times. there has been no resolution to this problem. in august 2009, the last time we approached him with this problem, his response was that he was thinking about replacing the carpet with hardwood floor, but that since we have 3 dogs, he is considering asking for a pet security, which is not written into the lease. is he able to do that? he claims that he did not know that we had 3 dogs. we had a realty company show us the house and we communicated several times to the individual showing us houses that we had no interest in any houses that did not allow pets. we asked the realty company several times (we have emails proving it) during the lease negotiations about the pets being okay with the landlord. we never received any negative replies. since we signed the lease with the understanding that everything was okay with the landlord and our pets, is our lease valid or was it signed under 'false pretenses?' a final note...the realty agent was our contact during the entire time of the lease negotiations...the landlord made absolutely no effort to contact us. we asked for his contact number and the realty agent told us that she was 'taking care of this for him,' as she was a friend of his. any input would be greatly appreciated.
 
You have several issues here.

1. Is lease valid? Yes unless one of the parties can prove they were decieved by other and even its tough.

2. Can he amend lease? No he cannot without your consent

3. The carpet odor. that one is on you. You did walk through and accepted teh aprtment as it was. Which deemed worthy to move in. You might save your complaints though so Landlord doe snot claim the odor came from your dogs when you try to leave and bills your deposit for replacment carpet

We are trying to be 'smart' about this property. The landlord is one that just doesn't want anything really to do with the place...he wanted to sell it, but it wouldn't sell, so he rented it. We have documented and taken pictures of EVERYTHING on the day that we moved in. We have sent a copy of all documents and pictures to the realty company involved to put in a file so that it is clear that the documents and pictures were there within a very short period of time after we moved in. Also, we had sent a letter to the landlord, within a month of being here, stating the problems and concerns that we had with the property. We're trying to cover our butts so that we don't get stuck with anything that truly is not ours. As far as the pee smell goes...the house sat empty for 10 months, once we got in here and started moving around, within that first day, we noticed it. It is much worse when the sun hits it or the vacuum is pushed over it. It seems to bring it all to the surface. We can't eat in the dining room because of it. It's really not very pleasant. We're trying to make the best of it and just trying to get through the term of this lease. Live and learn! Thanks again.
 
Oh, one more thing. Just a quick question, more of an afterthought. What happens if we find out that the realty agent did not disclose everything to our landlord that we disclosed to that agent before the lease signing? I just have a feeling that some things that we considered important and communicated to the agent were not passed on to the landlord. I have the feeling that the agent just wanted to 'place' someone in here to take the burden of 2 mortgages off of her friend...our landlord.
