Alcohol & Drugs: MIP, MIC, Intoxication Inneffective Assistance of Counsel

Would someone be so kind and advise what this constitutes? My attorneys partner advise the last time he came to court he was hung over, she found cocaine in his car and he has a severe alcohol problem. Is this enough to claim the above and get my money returned to me?
 
Maybe fastest to contact the attorney, tell him what you know, and tell him you are thinking of filing a grievance against him unless he refunds your money. A grievance will cause him all kinds of hell, probably be best for him to pay you.
 
I doubt his partner will admit he was hung over. This is a case for a friend that I actually retained the attorney for. She is his ex so it is highly unlikely she will admit either thing if I made a threat. I realize this sounds strange but should I try to record her saying it again over the tel? Would this help me in any way?
