Inappropriate school teacher behavior questions

I have a few questions about inappropriate behavior by a school teacher in NY.
Before I file a complaint about this teacher I would like to know:

1. What type of lawyer do I contact for advice?
2. Is the evidence I have useable to file this complaint?
3. Is the evidence I have unlawful and should not be used?
3. Did this teacher break the law or is it just immoral behavior?


On Jan 25th 2008 my wife went to work at 6pm. I discovered later on in the
evening that she had called in sick at work and was not there.
When she got home, I asked where she was and what was going on.
She made up a story but seemed to be very worried.
I left the house and went out, upset. She had called me 2 times while I was
out.
Later that day I looked at the cell phone usage online, and after each call
she made to me that day, she called another number, the same number 3 times. This number was called before she left for work the night before.
Looking further back in the records I found this number going back to 2005.
It became more numerous as time went by.
I looked that number up in our personal phone book of family and friends. There it was, the names of our kids 5th grade teacher and his wife.
It was actually this guys cell phone.

That night I thought back to the Fall and my wife spending lots of time playing solitaire on my computer in my office.
I had installed a program to monitor activities the kids did on my computer which had no parental controls. It was just set up to monitor internet sites visited. I set it up to monitor AIM, Yahoo instant messenger, MSN and a key logger.

My wife denied anything was going on , they were just friends.
I let it go for the time being.

A week later the computer started logging conversations between them and
indeed revealing they were having an affair.
I watched them through the month of February printing out logs of their conversations. This was on my computer using my user login.
In March I revealed to my wife that I knew everything that was going on.
In March and April I recorded my personal phone conversations with my wife and in one she talks about the affair.
My wife continued to meet him when she volunteered at the school store through the rest of 2008. I know my younger son was present during this time.
My marriage was a wreck and in April I asked for a divorce.
I'm now divorced.
I have not called, threatened or confronted him. Mainly because I
did not want to end up in jail.

I did not report him to the school.

My sons both had him as a 5th grade teacher.
Older son Sept 2005- June 2006 school year.
Younger son Sept 2006- June 2007 school year.

From everything I have 2007 was when this all started.

I have sat on this for a while and feel I should report him to the school.
My children and I have suffered through much during and after the divorce.
It's very humiliating, and would be an embarrassment for the boys if this got out in the open. Many of their friends, neighbors across the street etc have had him for a teacher.
My wife has used these reasons in her messages to him of why I would never report him. I would never hurt the boys.
