According to the courts I have custody of my 11 year old daughter, but her father will not let her come back home. I went away to prison and was gone for 18 months; when i came home I allowed him to keep her until I got on my feet. Now I am doing well for myself. I'm a student at HBU, I work for a dental lab (I am the Office Manager), and I have a very nice home. The main thing is my daughter has been express that she wants to come back home, and has been saying so for over a year. I would like to share custody, but he is being so difficult. He says he is not allowing her to go any where and the only time I need to call is when I want to talk to her. That is crazy, even though see lives with him; I see her 3 times out of the week and take her to all her appointment and meet with teachers at school, ect. What do I do?

Did Dad ever file for temporary custody? If not then you can try calling the police to enforce the court order but since this is a civil manner they may not do anything. You might have to go to court and file a motion against Dad.

How far away does Dad live? If the child has been with him this whole time and is enrolled in a different school, are you sure its in the childs best interest to change now?
