I received a misuse of a handicapped placard ticket in California. I was the passenger of the vehicle, not the driver. The driver of the vehicle is 35 yrs old and he did not receive any ticket. Is this legal? Why did I receive the ticket and not the driver. Should I attempt to fight this? If I do fight it and I lose will the fine go up. The fine is already over $1000. Need advice!

Who is/was the owner of the handicap placard?
Has the placard expired?
Were you sitting in the car when the citation was issued?
 
The owner of the placard is my common law wife, which is my son's mom. My son was driving her vehicle and it was not expired. I was sitting in the passenger seat when the citation was issued.

The driver must have been a minor or was operating the vehicle with a learner's permit, right?
 
It sounds like your wife is the disabled person, and she was not in the vehicle. The citation is correct, you are just arguing that it should have gone to the driver rather than you. You can try and argue that point in court, however it was likely issued to you because you own the vehicle... though I suspect something was said at the time that made it clear that you were the one in control of the placard and responsible for its misuse. If the officer heard anything to help him determine that you were responsible then he properly cited you. This is not a moving violation that the driver is responsible for... it is a citation for misuse, and you, in the officer's opinion, were the one responsible.
