I'm 16 years old and I live in Texas. I'm currently living with my mom. My mom and I don't get along, there is a lot behind it. All of my friend's moms and even my therapist (who I went to specifically for this) who is rated the best in the county for teenagers agrees that I should move in with my dad. But my mom is the type of person that will not give up and if I move out, even though in 8 months it will be legal for me to live on my own, she will fight it. She will do anything to get what she wants, even lie and manipulate. But she is seen as this great person. Someone I work with who has been through this told me today that since my parents have joint custody and my dad lives only 5 minutes away, that I can pack up my stuff and leave her house and can not be reported as a runaway if I'm living with my dad because he is also legally my guardian & I am over the legal age for choosing who I live with. I know that I have to file a motion with the court to modify the divorce decree, but that might take months and I cant stand it. So until then My question is, if my mom were to call the police and said I was refusing to come home from my dad's, they could not force me home correct? If it was my decision and not his, I couldn't be in any legal trouble? Thank you SO Much.
