I have physical custody of our 13yr daughter, in the sep agre, however 2 weeks ago my wanted to go to the skating ring,by this time I already left for work, when she asked me, I told her no that she couldn't go and that she should have discuse this with me sooner, she got really upset and hung up on me, I called her back and said I will be taking her phone when i get home. When i got home at 9:15pm she was gone. I had no idea where she was or anything, a few hours latter she pulls up with her mom.Her mom then drops her off at my parents house, which was ok to me, to let everything cool down. The next day I pick her up from my parents house, we talk on the way home, I told her I was very dissapointed in her behavior. She says to me she going to live with mom, I said no you stay over for a few weeks for summer, moms lives about 5min from me. 2 weeks go by she comes over when I'm at work and starts packing her clothes, I told my ex she not moving in with you, she just there for a few weeks for summer, my ex agreed. Yesterday child services called me and ask me If my daughter still lives there I told them yes she with mom for a few weeks. They said ok just checking, my ex called and said my daughter lives with her now. A year ago my ex gave me physical beacuse all the arguing and fight that was going on at her apartment, she never home now she into the club seen, and when she leaves her other kids at home very late at night, she doesn't answer their calls or text. This is only part of the problem.

If you have a court order that gives you physical custody and your ex has violated the visitation agreement, then you can file for contempt of the order.

However, before you go to court, try to pick up your daughter at her mom's. If she refuses, ask the police to accompany you so that you have a police report of her refusal to return her.
