I have a full custody order and need to assign custody to family member

Hello,

I am currently in the process of enlisting into the Navy and since I am going in Active duty the Navy want's me to assign custody of my daughter to either a family member or friend (for a full military enlistment term of 4 years).

I currently have SOLE LOCAL AND PRIMARY PHYSICAL CUSTODY of my daughter. I know this is very rare that a parent has sole custody of a child but it happened in my chase. Anyway, I do have family who is willing to care for my daughter while I serve the United States Navy. How do I go about this? I received the Custody order from the state of Pennsylvania however me and my family live now in Florida. Do I just go to court and file for a temporary custody or should I hire a lawyer? How long does this process take to get temporary custody?

Where is the father? You cannot assign custody to someone other than the father. Full custody does not mean the dad has no rights. Dad has rights to custody over anyone else.

if you want to assign guardianship of the child to a family member, you will still need to inform dad, have him served. if he contests to it, barring any legal reason he is unfit, he will be granted custody.

if he is found unfit by the state laws, then it may be possible to have it court ordered guardianship to a family member.

What if the father is NOT on the birth certificate? Does she still need permission from him before she assigns custody to a family member?

She has to get the rights of the father terminated or released. She needs to contact all the men who could be the father. THEY HAVE A RIGHT TO BE THE FATHER. This isn't just about her. If they find out that the child is to be adopted and they refuse to step forward THEN the baby can be adopted. Both this child and the father deserve that opportunity and the law demands it.
