My friend's husband has dementia, is undergoing chemotherapy for cancer. He is not thinking clearly, not paying his bills and they do not have joint account in bank accounts. She wants to get guardianship, but S. Carolina court says she must see a lawyer, AND the children have to be notified and agree. They are not her children, he was married before. Could someone explain how this works?

I suggest she discuss this matter with a lawyer or two and proceed as the lawyer directs.

Generally, a guardianship or a conservatorship, are complicated processes where a lawyer can be very helpful.

This might be helpful while your friend lines up an appointment with an attorney or two:

Thanks for links. I checked the first one and realize it's complicated, and she's in a bind.

it will also not be a quick process.

My wife obtained guardianship over one of our adult sons, who lapsed into a coma and lingered fro 11 years after the sad event which precipitated his condition.

I'm a lawyer, who used associates at my law firm to litigate a "medmal" lawsuit, and obtain guardianship in Texas.

The guardianship took about a month to conclude.

I suspect the right attorney can get the matter docketed for an emergency hearing, especially since their funds are in limbo.
