How to stop support

I have been having to pay child support for my daughter for a little over two years now. About 8 months ago my daughters mother went to prison and I have had my daughter living with me for this time. I can prove that I have had her in my care...is there a way to stop my order for support?I shouldnt have to pay support if I am the one taking care of our child, right?

If your ex had primary custody, you should request a hearing to modify custody through the court due to her incarceration. Go on from there to modify support.

There is no legal custody established...she had her for 2 years previous to her going to prison because she bounced aound and kept my daughter from me. I had to pay support because she was on welfare. Dont I have to have legal custody before I can modify it?

You need to get legal custody. However, in the meantime you can go in and talk to the CS office to see if they will stop the CS on their on.
