Hi:

I have been engaged in a dispute with a merchant who willfully submitted a charge for an item I tried to cancel before delivery. My credit card company, Capital One, initially settled in my favor. Then the merchant sent them a letter containing two very distinct lies, thereby convincing them to reverse their decision.

I have since proved a portion of the lies. Conclusive proof, however, is dependent on phone records. Herein lies my delemma.

One of the calls was to the merchant, who is less than a mile from my home. The other was to the Capital One's 800 number. Niether of these calls shows up on my phone bill because there are no tolls involved. The phone company says I need to supeona the information. Capital One is just plain uncooperative. So it would appear that to get the info I will have to supoena both parties.

How do I go about this?

Thanks for your help,

Tim
