Subject: Can we penalize a judge and if so , how?
I am not a lawyer so I hope I am in the right place to ask a question.
My friend just had all parental rights taken away.
There is no findings of abuse or neglect and her CPS case had been
closed and rendered unfounded.
However it took her 3 years (almost) to jump through the hoops and to
complete everything that CPS asked of her. (Man, if I could just
relate to you the whole story, you would want to pull your hair out at
the injustices this woman endured).
She is not an educated person and like the average American had no
idea what any of her rights were or might be. She is/was ignorant of
our basic civil rights and the steps of due process.
At the beginning of this whole ungodly mess, she voluntarily gave
custody to the paternal grandparents.Cps had threatened to 'take her
kids away so that she never sees them again' at the beginning of
this.. In fear of foster care, she signed them over.
Now that the process of evaluating the fitness of this woman as a
mother is over, case closed, she went before the judge to have her
parental rights restored. ( all this with out an attorney).
The judge denied her petition and has awarded custody to the
grandparents. No explanation, no reason, no cause was given to her by
the judge. Boom, kids no more even though she was Not found guilty of abuse or neglect .
We live in Texas.Does that imply anything as to how difficult it may
be to be treated fairly under the law in the courts ? Well the good
ol' boy system is alive and well here !
How can we go about appealing the courts judgement? How can an
unfair judgement in a custody case be appealed? How do you go
about repremanding an unfair, biased judge that has no regard or
respect for the law?
Please, this case has so many horrific details too numerous to
describe in this forum. This was unfair and absolutely wrong from the
get go. Where might I research or possibly find out a way to get that
judge to answer for what he did and did not do
concerning this case?
How does a person go about having a judge at least looked at by his
or her peers, when that judge is corrupt, and banking on the ignorance
of his victims to keep the injustices silent? Where does one start?
Please, if anyone could just point me in the right direction you will
be performing a miracle.Help us at least get that judge and his
actions reviewed. Administrative hearing? Texas Bar Assoc. ?
Thank you for reading this long message. I have tried to be as
eloquent as I could but this whole mess has me angry.
I believe in our
constitution and our civil rights and liberties and due process. And
to see it so blatantly abused infuriates me.:cussing:
She was appointed a court attorney however there was some sort of conflict of interest.... However you look at it, this woman was not represented nor treated fairly ..
I have not adequately in detail described her whole ordeal unfortunately space does not permit it.
Suffice it to say, she received less than equal and fair treatment because of her lack of education and economic status. This should not have any bearing on treatment in the court room. I am willing to do what ever i can to help her get some redress and hopefully an equal playing field next time round. This judge needs to be reprimanded .
